1. What are the terms of Shipping?
Delivery to the address indicated by the Customer at the time of purchase is made from Monday to Saturday via a carrier chosen by SoSolido within 5-7 working days of receiving the order confirmation. Since the goods are prepared and entrusted to the courier within 2 working days of the order confirmation, after this period of time it will no longer be possible to make changes to the order.
The delivery obligation is considered fulfilled when the Product is transferred to the Customer who acquires full material availability. The risk of loss or damage to the Products, for reasons not attributable to SoSolido, will be borne by the Customer when the Customer or a third party designated by him physically takes possession of the Products.
In the event of non-delivery due to the absence of the recipient at the address specified at the time of the order or in the event that the Customer expressly refuses to take delivery of the ordered Products, the sales contract will be considered terminated pursuant to art. 1456 of the Civil Code: the cost of the entire expense will be charged and the Customer will have to place a new order. The Customer who has requested home delivery but has not collected the products due to repeated absences or refuses to collect them, will be charged for any redelivery and storage costs.
The Customer must verify that there are no obstacles to accessing the delivery address indicated or impediments that make it difficult to carry out. In any case, the Customer must inform SoSolido. The personnel making the delivery cannot be asked to bring the Products into the Customer's home.
The Customer acknowledges that the withdrawal of the Product is his precise obligation deriving from the Contract of Sale.
In the event of failed or delayed delivery with respect to the delivery terms indicated in these General Conditions of Sale, the Customer, pursuant to art. 61, paragraph 3 of the Consumer Code, invites SoSolido to make the delivery within an additional term appropriate to the circumstances. If this additional term expires without the Products having been delivered, the Customer is entitled to terminate the Contract of Sale, without prejudice to the right to compensation for damages.
2. What are the terms of Withdrawal?
Pursuant to art. 52 of Legislative Decree 206/05, the Consumer may withdraw from the contract, without having to provide any reason and without penalty, within 14 (fourteen) days of receipt of the purchased products. The Customer who intends to exercise the right of withdrawal must send - within the aforementioned term of 14 (fourteen) days - an explicit declaration to that effect, to which a copy of the purchase receipt and the code of the purchased item must be attached. This communication may be sent by e-mail to the following e-mail address: sosolidoshop@gmail.com. In any case, the Customer undertakes to return the goods, without undue delay and in any case within 14 (fourteen) days from the date of communication of the withdrawal, arranging the shipment and/or the relative methods of return, with the awareness that the costs of returning the product are at your expense. SoSolido will refund the price of the returned product; the Consumer must provide SoSolido, by accessing the "Contacts" section, with the bank details (IBAN), necessary for the reimbursement. In the event of valid exercise of the right of withdrawal, SoSolido will reimburse the Consumer for all payments received in relation to the product, for which the right of withdrawal is exercised, within 14 (fourteen) days of receipt of the communication concerning the intention to withdraw. In any case, SoSolido reserves the right to withhold the refund until the Consumer returns the product or until the Consumer has provided certain proof that the goods in question have been returned to SoSolido. In any case, it is understood that the essential requirement for the valid exercise of the right of withdrawal consists in returning the goods intact, which must be returned to SoSolido intact, in the original packaging and complete with the attached tax documentation. Failure to comply with the prescribed provisions legitimizes SoSolido to refuse to exercise the right of withdrawal and return the purchased product.
Pursuant to art. 130 of the Consumer Code, in the event of a lack of conformity of the products purchased, the Consumer has the right to restore, without charge, the conformity of the product, by repairing or replacing the goods. The Customer can exercise this right within the term of 2 (two) years from the date of delivery of the goods and is required to report the defect to SoSolido within the forfeiture term of two months from the discovery of the defect. Even in this case, the requirement essential for the valid exercise of this right consists in returning the goods intact, which must be returned to SoSolido intact, in the original packaging and complete with the attached tax documentation.
